Employees on commission

The indemnity for the notice of termination of employment is calculated in the following way:

  1. the length of the notice must be determined according to the number of years of uninterrupted service;

Uninterrupted service

Length of the notice

3 months to 1 year

1 week

1 year to 5 years

2 weeks

5 years to 10 years

4 weeks

10 years and over

8 weeks

  1. the average weekly wage during the complete periods of pay in the three months preceding the end of employment must be determined;
  2. it is also necessary to calculate the indemnity based on this information;
  3. and finally, check if this wage complies with the Act respecting Labour Standards.
Note

The tool may be used to make retroactive calculations over a period of one year, from the date of the day. It does not take into account the longer prescription period that applies in the case of forestry workers.
