An employee may be absent from work for a period of not more than 104 weeks if the death of the employee’s spouse or child occurs during or results directly from a criminal offence.

An employee whose spouse (see the definition and interpretation of the word "spouse" in section 1 3) ALS) or child (regardless of whether the child is a minor or not) dies following a criminal offence is entitled to be absent from work without pay.
The death of the spouse or the child must occur at the time of the criminal offence or be a direct result thereof.
