The National Holiday Act applies to the majority of Québec employees. However, some employees are excluded from this legislation:
- self-employed workers within the meaning of the Act respecting labour standards;
- the employees of the Canadian Armed Forces;
- the employees of enterprises subject to the Canada Labour Code:
- a) international and interprovincial services:
- road transportation,
- railways,
- maritime and river transportation and related services,
- telephone, cable and telegraph networks,
- pipelines
- ferryboats, tunnels and bridges;
b) radio and television broadcasting including cable distribution with the exception of Télé-Québec; - c) air transportation, airplanes and airports;
- d) banks;
- e) grain elevators;
- f) extraction and processing of uranium;
- employees of an embassy or a consulate.
