Calculation of the indemnity for statutory holidays with pay and the national holiday
Employees receiving gratuities

The indemnity for statutory holidays with pay and the national holiday is calculated in the following way:

  1. first, it is necessary to determine the weeks used in the calculation and to establish the weekly wage for each of these weeks;
  2. next, these weekly wages must be added up;
  3. finally, the indemnity is calculated by using these formula:
    • 1/20 of the wages earned during the four complete weeks of pay preceding the week of the holiday, excluding overtime, but including tips.
Note

This tool is not intended for an employee subject to the Regulation respecting minimum labour standards in certain sectors of the clothing industry. The tool may be used to make retroactive calculations over a period of one year, from the date of the day. It does not take into account the longer prescription period that applies in the case of forestry workers.

The calculation tool cannot process the case of an employee receiving gratuities and having worked overtime. This is an exceptional case.
