Worker not covered by the Act respecting labour standards
The Act respecting labour standards protects the majority of Québec employees. However, some employees are totally or partially excluded from the Act.
Are totally excluded
A self-employed worker within the meaning of the Act respecting labour standards
The employees of the federal government and its corporations
The employees of the Canadian Armed Forces
The employees of enterprises subject to the Canada Labour Code:
a) International and interprovincial services related to:
road transportation
railways
maritime and river transportation and related services
telephone, cable and telegraph networks
pipelines
ferry boats, tunnels and bridges
b) radio and television broadcasting, including cable distribution, except Télé-Québec
c) air transportation, aircraft and airports
d) banks
e) grain elevators
f) extraction and processing of uranium
An employee who works both in Québec and outside Québec for an employer who does not have a residence, domicile, enterprise, head office or office in Québec
An employee who works solely outside Québec, but who is domiciled or who resides in Québec, for an employer who does not have a residence, domicile, enterprise, head office or office in Québec
The employee of an embassy or consulate located in Québec
A health care professional (s. 19 of the Health Insurance Act)
A person who performs compensatory work (art. 340 of the Code of Penal Procedure)
A confined person (s. 202 of the Act respecting the correctional system)
A person who works within the context of an employment assistance measure or program (s. 11 of the Individual and Family Assistance Act and s. 6 of the Individual and Family Assistance Regulation)
Are excluded from all standards, except those concerning: retirement, psychological harassment family obligations
An employee subject to the Construction Decree
Senior managerial personnel
Are excluded from all standards, except those concerning: retirement and psychological harassment
A worker who is a party to a contract, whose remuneration is set by regulation of the Government of Québec
A student who works during the school year in an enterprise chosen by the educational institution under a work induction program approved by the Ministère de l'Éducation, du Loisir et du Sport
a person who cares for others and who performs his work:
a) in the dwelling of the person cared for,
b) on an occasional basis or
c) whose employment is based on a relationship of assistance to the family or community help;
d) and for whom the employer is not seeking to make a profit.
