What the Act says
The Act respecting labour standards contains provisions concerning complaints related to wages that protect the majority of Québec workers, whether they are full or part time.
An employee can file a complaint with the Commission des normes du travail if he believes that his employer is not respecting his rights concerning, notably:
- the payment of his wages
- his overtime
- his vacation indemnity
- the calculation of a statutory holiday indemnity
- his termination of employment indemnity.
The Commission des normes du travail can institute legal proceedings on behalf of the employee to try to collect the sums that are owing to him for the work that he performed.
Time period
You have one year to file a complaint from the date of the offence, namely from the date on which your employer should have paid you.
