Bankruptcy and changes in the enterprise

Remember

  • If the operation of the original enterprise is continued by the new employer, the sale of the enterprise has no effect on your uninterrupted service.
  • Barring exceptions, if your employer has declared bankruptcy, the Commission des normes du travail can institute legal proceedings against the employer on your behalf.

The uninterrupted period during which the employee is bound to the employer by a contract of employment, even if the performance of work has been interrupted without cancellation of the contract, and the period during which fixed term contracts succeed one another without an interruption that would, under the circumstances, give cause to conclude that the contract was not renewed.

Meet with your employer

Clarify the situation and, wherever possible, resolve the problem.

This approach often allows you and your employer to settle the problem and to avoid having to file a complaint with the Commission des normes du travail. It is in your interest and that of your employer.
